Attorney General expects to announce successful ANA candidates in coming weeks: spokesperson

The office of the Attorney General is making progress on setting up the Authorized Nominating Authority (ANA), as part of its strategy to settle disputes under the new Ontario Construction Act.

“The Call for Applications to identify a candidate to be designated to act as Authorized Nominating Authority was issued on March 15, 2019, and applications were due on April 9, 2019,” said Ministry of the Attorney General spokesperson Brian Gray in an email to Ontario Construction News. “It is anticipated that the ANA will be announced in the coming weeks.”

The ANA will develop and oversee training and certification for adjudicators, and maintain a registry of qualified adjudicators who will be appointed to disputes as they arise, Gray said. The panel will also publish materials to spread the word about the adjudication process.

There is no word yet on the number or caliber of candidate applications.

The ANA is part of the changes to the Ontario Construction Act. Its new rules regarding prompt payment and dispute resolution are set to come into affect on October 1, 2019.
The modernized law denotes specific notice requirement, payment, and dispute resolution systems.

These regulations were approved and filed on April 23, 2018
