BCA: Full day Ontario Construction Act seminar scheduled for June 19

The Barrie Construction Association (BCA) is offering members a free full-day seminar about the new Ontario Construction Act on June 19.

The program, co-ordinated by Robert Kennaley of Kennaley Construction Law will explain the legislation and advise members on how they can take advantage of its changes.

“Since the late 1800s, the Construction Lien Act (formerly the Mechanics Lien Act) has (literally) controlled the flow of money on a construction project through mandatory construction trust and holdback obligations,” says the course description. “It has also provided remedies which the suppliers of services and materials would not otherwise have, through the construction trust and the construction lien. The rights, obligations and remedies have always been complicated, and breach of the obligations can have severe consequences. Accordingly, it has always been important for everyone in the construction industry to have a basic understanding of how the provisions work.”

“Now, the name of the Construction Lien Act has been changed to the Construction Act, and the construction trust, holdback and lien provisions have been changed in significant ways. In addition, a whole new set of obligations and remedies have been added, through mandatory “prompt payment” and ‘adjudication’ provisions. These will undoubtedly have a greater impact on the construction industry in Ontario than anything that has happened since the Second World War.”
