Special to Ontario Construction News

The Canadian construction industry operates within a broad and complex legal landscape that is constantly evolving. All professionals engaged in construction projects need to develop a working knowledge of the latest legal and risk management issues and techniques in order to adapt to the rapidly evolving construction legal landscape.

To address this need, OsgoodePD offers an industry-focused Certificate in Construction Law program (the “Certificate”) led by Jason Annibale (McMillan LLP), Geza Banfai (McMillan LLP), Howard Krupat (DLA Piper LLP) and Tim Mavko (Reynolds Mirth Richards & Farmer LLP) and 30+ multidisciplinary experts, designed to provide everyone in the construction industry with the latest knowledge and strategies to deal with important legal risks, developments and trends.

Over five modules and following the flow of a typical project, the Certificate begins by delving into the various project delivery models and players, and then tackles construction contracts and key terms. Focus then shifts to bidding and tendering and recurring claims issues including scope changes, extras and delay and impact claims, as well as key area affecting construction like labour, occupational health and safety, bonding, insurance, insolvency and environmental issues. The final day delves into dispute resolution, including perspectives from a judge, mediator, arbitrator and adjudicator, and examines key technology in use in construction and engineering and how developments in ‘green construction’, ESG and sustainability are impacting the industry.

In response to its national and perennial popularity with 600+ professionals to date, OsgoodePD offers the certificate semi-annually and it now also features important distinctions for projects in Eastern and Western Canada and the flexibility to participate live or by viewing the recorded program (or both).

Focusing on real-world situations, the certificate offers opportunities to reinforce key concepts in a mix of interactive instructional sessions and discussions, small group breakouts and live workshops. It also enables professionals to connect with and learn from legal and industry experts and a national cohort of peers, making it a “can’t-miss” opportunity for those looking to network and grow their careers.

The certificate is highly recommended for owners, developers, architects, engineers, project managers, as well as for contract, procurement and legal professionals and anyone involved with a construction project.

Past certificate participants include Giovanni Cautillo, president of Ontario General Contractors Association (OGCA), who found the program to be “incredibly informative and engaging” and Sandra McLaughlin, Assistant Director of the British Columbia Institute of Technology (BCIT), who praised the program’s “outstanding content and discussion.”

Due to the popularity of the program, space is limited and potential participants should register in their chosen session as soon as possible. Upcoming certificate offerings include:
